These Terms of Service ("Terms") govern your access to and use of the PostNitro website, applications, APIs, products, services, and any related content (collectively the "PostNitro Service"). Using the PostNitro Service, you confirm your agreement to be bound by these Terms. If you disagree, do not access or use the PostNitro Service.
You must be at least 13 years old and able to enter into legally binding contracts to access and use the PostNitro Service. You further represent that you are not barred from receiving any aspects of the Service under applicable laws.

PostNitro may modify, suspend, or discontinue any aspect of the Service at any time and without notice. You acknowledge that PostNitro has no obligation to maintain, update, or provide any aspect of the Service. The Service is provided on an "as is" basis without warranties. PostNitro disclaims all express or implied warranties, including accuracy, merchantability, fitness for a particular purpose, and non-infringement.
Any content uploaded, transmitted, or shared by you on the Service remains your property. However, you grant PostNitro a worldwide, perpetual, royalty-free license to access, use, reproduce, distribute, modify, and display such content solely to operate the Service. You represent and warrant that you have all the necessary rights to upload or share any content. Doing so does not violate any third-party rights. You are solely responsible for your conduct and content on the Service. PostNitro is not liable for any user content.
You agree not to misuse the Service or assist others in doing so. This includes hacking, violating laws, distributing malware/spam, infringing intellectual property, harassing others, or attempting to gain unauthorized access. If you violate these Terms, PostNitro may suspend or terminate your account.
PostNitro retains full ownership of all aspects of the Service, including all intellectual property rights in the websites, applications, content, trademarks, brands, logos, databases, software, and code. Nothing grants you any implied ownership or licenses.
Certain aspects of the Service may require payment of fees. You are responsible for all applicable taxes and charges associated with using paid aspects of the Service. Non-payment of fees may result in suspension or termination of your account.
You may cancel your PostNitro account anytime by logging in and selecting account closure. Any paid subscription fees are non-refundable. Upon cancellation all licenses granted to you will immediately terminate. PostNitro reserves the right to suspend or terminate your account for any breach of these Terms. We will attempt to notify you before termination but are not obligated to do so.
The PostNitro Service is provided on an "as is" and "as available" basis without warranty. PostNitro expressly disclaims all liability arising from the use of the Service. Under no circumstances is PostNitro liable for any indirect, incidental, consequential, special, or exemplary damages arising from using the Service. PostNitro's liability cannot exceed any fees paid by you to PostNitro for the use of paid aspects of the Service.
You agree to fully indemnify, defend fully, and hold harmless PostNitro and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the PostNitro Service, violation of these Terms, or violation of any rights of any third party.
PostNitro may revise these Terms occasionally, and the changes will be effective immediately upon publishing. We will indicate changes by updating the "Last Modified" date. Your continued use of the Service constitutes acceptance of the amended Terms.
